As of October 1st, 2016; participation in Nevada’s ELT Program is now
required for any lenders who finance more than 27 vehicles annually.
This means that if you need to place a lien on a Nevada title you must
sign-up with a 3rd-party vendor that interfaces with NV ELT.<br />
<br />
Nevada’s Electronic Lien and Title Program officially launched in September 2015 and was divided into 3 phases.<br />
<br />
<ul>
<li><b>Phase 1:</b> In the first year, lenders are not required by the
state to enroll in the ELT Program. Participation is optional and “Paper
Titles Only” as a method of business is still available. </li>
</ul>
<ul>
<li><b>Phase 2:</b> In year 2, participation is now required for any lender that finances over 27 vehicles in 12 months. <span style="color: red;">This is the current phase.</span></li>
</ul>
<ul>
<li><b>Phase 3:</b> Projected for implementation in the fall of 2017; participation in Nevada ELT will be Mandatory for all lenders. </li>

<a href="http://www.ncdot.gov/dmv" target="_blank">North Carolina</a> launched a voluntary ELT program on November 1, 2014 with the expectation of the program eventually requiring <a href="http://etitles.blogspot.com/2014/05/north-carolina-elt-program-on-schedule.html" target="_blank">mandatory participation</a>. According to House Bill 1133 and Senate Bill 407, <span style="color: #cc0000;">all individuals and lienholders who finance motor vehicles will be required to participate in the NC ELT program beginning on January 1, 2016</span>. The only exception to the mandatory requirement is for individuals and lienholders who process less than five lien transactions per calendar year.<br />
<br />
Once the grace period ends, if a lender conducts five or more transactions annually and does not have an ELT service provider, the title transactions will be rejected by the DMV. If this occurs, the DMV eDS ELT helpdesk will inform the lienholder of the approved service provider list to eliminate any further delays. Please note: there are no financial penalties associated with a DMV title application rejection.<br />
<br />
A printed title may be requested for an ELT in the event of a repossession or an owner moving out of the state. All printed paper titles will be sent from the Raleigh DMV office. The North Carolina title and lien recording applications will remain the same and there will be no changes to current state fees.<br />
<br />
Enrolling early in the ELT program will help the state handle the large number of anticipated required participants. DDI works with lenders and DMVs in all 50 states and is a certified ELT service provider in the 22 ELT states. This enables DDI to help make the
transition from paper titles to ELT both simple and effective for North Carolina ELT participants. <br />

The state of Colorado has <a href="https://www.colorado.gov/pacific/dmv/electronic-lien-and-title" target="_blank">provided updated information</a> regarding their upcoming ELT program. According to the <a href="https://www.colorado.gov/dmv" target="_blank">Colorado Department of Revenue Division of Motor Vehicles</a>, the state will officially launch their ELT program on May 1, 2015.<br />
<br />
There are a few steps to follow when transitioning into Colorado’s ELT program. First, the lienholder or lender will be required to enter into an agreement with one of CO’s approved Service Providers. The option to apply for an “E” number will then become available. Once a lien is notated, the certificate of title record will be stored electronically in the CO ELT system. A participating lienholder or lender will be notified electronically through their Service Provider. With the ELT program, an electronic notification to the lienholder serves the same purpose as receiving a paper title in the mail.<br />

According the <a href="http://www.dmv.virginia.gov/commercial/lien/elien_mandate.pdf" target="_blank">Virginia Electronic Lien Mandate</a> published by the Virginia DMV, "all banking and financial institutions that record 50 or more auto liens per year will be required to electronically transmit lien information to the <a href="http://www.dmv.virginia.gov/" target="_blank">VA DMV</a> through an approved service provider." As a result of the mandate, ELT participation will be required beginning October 1, 2015 for those institutions.<br />

<li>Lenders will have the ability to request and receive paper titles. </li>
<li>The ELT program provides for an immediate lien release for title printing pickup at DMV offices in Huntersville, Charlotte and Raleigh. There will be a state fee for this service. </li>
<li>Requested paper titles can also be mailed to the lender. An alternate mailing address can be specified for mailing printed titles, with or without liens. </li>
<li>NC has implemented a state transaction fee. The per-transaction state fee for lien notifications is $3.50. </li>
<li>To recover their costs, participating lienholders or their agents may charge the borrower of a motor vehicle loan or the lessee of an automotive lease an amount equal to the transaction fee per lien notification plus a fee in an amount not to exceed $3.00 for each electronic transaction where a lien is notated. </li>
<li>MANDATORY PARTICIPATION: Beginning January 1, 2016, all individuals and lienholders who are normally engaged in the business or practice of financing motor vehicles, and who conduct at least five transactions annually are required to enroll in the NC ELT program. </li>
<li>Lenders will receive a new lien notification each time an additional lien in placed on a title and each time a lien is released, regardless of their lien position. As a result, lenders can release their lien on a title, regardless of position. </li>

The 2014 Premier eTitleLien® Users Group Conference and ELT Symposium has ended. We had a great conference with topics on vehicle lending legislation (including an update on the impact of the <a href="http://www.consumerfinance.gov/" target="_blank">Consumer Financial Protection Bureau</a> (CFPB)), requirements and restrictions related to eSignature and electronic transactions, upcoming state changes to ELT programs, a Question and Answer time with several state DMVs, and a look at some of the new features implemented in <a href="http://www.etitlelien.com/">Premier eTitleLien®</a>.<br />
<br />
All the staff from <a href="http://www.dditechnology.com/" target="_blank">Decision Dynamics, Inc.</a> who were able to make it this year in Savannah were very pleased to be able to meet with our users again face to face. We had many enlightening discussions about changes to their companies and changing needs for vehicle lending. We were also happy to have attendees representing both the <a href="http://www.scdmvonline.com/" target="_blank">South Carolina</a> and <a href="http://www.azdot.gov/mvd" target="_blank">Arizona</a> DMVs, as well as remote participation from the <a href="http://revenue.alabama.gov/motorvehicle/index.cfm" target="_blank">Alabama</a>, <a href="http://www.dmv.ca.gov/" target="_blank">California</a>, and <a href="http://www.flhsmv.gov/" target="_blank">Florida</a> DMVs.<br />
<br />
One of the last presentations highlighted a growing service at DDI that came up frequently throughout the conference: The Premier Title and Registration Service Center. "Be the Hero!" was the theme for the DDI Title Center (as it is referred to) which offers several services that supplement Premier eTitleLien®:<br />
<ul>
<li>Process title application or registration forms. This was of particular interest for customers who only occasionally need to work outside their home state.</li>
<li>Vault paper titles for states that do not have an ELT program. This allows paper titles to be "electronic" and for Premier eTitleLien to be a single point for managing all titles.</li>
<li>Provide estimates of title and registration fees.</li>
</ul>

The North Carolina Division of Motor Vehicles is on schedule to implement the North Carolina Electronic Lien and Title (ELT) program by their deadline of July 1, 2014. Full details of the program are not yet available, but DDI expects to begin testing in June and will begin enrolling customers for participation as details are made available.<br />
<br />
<a href="http://etitles.blogspot.com/2013/07/north-carolina-elt-bill-signed.html">NC legislation</a> specifies that the program is mandatory for all individuals and lenders who normally finance motor vehicles beginning July 1, 2015, giving lienholders 12 months to enroll before the deadline.<br />
<br />
DDI continues to work with NC Bankers Association members as the <a href="http://etitles.blogspot.com/2013/10/decision-dynamics-endorsed-elt-vendor.html">endorsed ELT vendor for Community Bank Services</a>. Our team will be hosting instructional webinars prior to July 1 to answer questions about the NC ELT program.<br />

DDI had the privilege of meeting with the <a href="http://www.mva.maryland.gov/" target="_blank">Maryland Motor Vehicle Administration</a> (MVA) today to discuss their plans to implement their new ELT program. Maryland announced their <a href="http://etitles.blogspot.com/2013/07/maryland-implementing-elt-program.html" target="">intention to implement an ELT program</a> in April 2013 and issued an RFP looking for service providers. DDI received a contract to become a Maryland Electronic Lien Service Provider in April 2014.<br />
<br />
The MD MVA outlined their plans for the first phase of the MD Electronic Lien Service program. Initially the ELT program will include the basic transactions, primarily: a notification of lien from the state and release lien and request for a printed title from the lender. Their expectation is to begin testing the first phase of the program with DDI in June 2014 and to begin processing regular ELT transactions with participating lenders in July 2014. <br />
<br />
DDI is working with the Maryland MVA on additional details, including the enrollment processes for lenders to begin participating in the ELS program. DDI's ELT solution, <a href="http://www.etitlelien.com/" target="_blank">Premier eTitleLien®</a>, already incorporates a number of features for handling titles in Maryland, including generating forms and <a href="http://etitles.blogspot.com/2013/10/cu-times-title-fraud-makes-case-for-elt.html">retrieving title record information</a>. <br />

The Wisconsin Department of Transportation Division of Motor Vehicles has offered different types of electronic transactions for lenders even before beginning their <a href="http://etitles.blogspot.com/2013/07/what-is-elt.html">Electronic Lien and Title</a> (ELT) program in 2012. <br />
<br />
Since July 1, 2010 the WI DMV requires lenders to electronically process lien add transactions. There are exemptions for individuals and lenders who normally file very few liens. Lenders who are not exempt and do not file electronically are assessed an additional $25 transaction fee. For details about exemptions and fees please see the WI DMV <a data-cke-saved-href="http://www.dot.wisconsin.gov/business/dealers/financial-inst.htm" href="http://www.dot.wisconsin.gov/business/dealers/financial-inst.htm" target="_blank">Financial Institutions page</a>. DDI works with the WI e-MV Agent program to integrate electronic lien filing into <a href="http://www.etitlelien.com/">Premier eTitleLien®</a>.<br />
<br />
Two changes were made to the title / lien program in 2012. They became, in their words, a "title to lienholder state" and an "electronic title state". Previously, Wisconsin sent titles with liens to the vehicle owner once the lien had been recorded. (States with such programs are sometimes referred to as <a data-cke-saved-href="http://allabouttitles.com/TitleHolding.aspx" href="http://allabouttitles.com/TitleHolding.aspx" target="_blank">title holding states</a>.) Most other states have lienholders store the vehicle title until the loan is satisfied.<br />
<br />
Wisconsin also began offering electronic titles to lienholders through their Electronic Lien and Title Program (ELT). The program is currently optional: "lien holders are encouraged to receive titles electronically via electronic service provider." The Wisconsin DMV has discussed requiring participation but are not currently planning to do so. Since launching the ELT program, WI has made steady improvements, adding additional ELT program transactions.<br />
<br />
The combination of the electronic transactions offered through the e-MV Agent program and the ELT program brings together a number of valuable services for lenders:<br />
<ul>
<li>Vehicle Title Information and lien verification</li>
<li>Immediate lien notation </li>
<li>Immediate lien release</li>
<li>Paperless lien transactions</li>
</ul>

DDI recently had the privilege of meeting with the Nevada DMV to provide feedback about our experiences with the ELT programs of other states. Nevada is <a href="http://etitles.blogspot.com/2013/07/nevada-legislation-requires-elt.html">required to implement an ELT system</a> and was meeting with us to talk about our ELT system, implementation timelines, communication protocols, and other electronic lien and title system details.<br />
<br />
We discussed with them some of the pros and cons of different message formats, and message exchange. We noted some of the best features of some state ELT programs (much of which is listed on our <a href="http://allabouttitles.com/" target="_blank">AllAboutTitles.com</a> site) and highlighted four considerations sometimes overlooked when designing a new ELT program:<br />
<ul>
<li>Allow electronic notation of lien</li>
<li>Require ELTs to be released electronically</li>
<li>Allow electronic payment of fees</li>
<li>Provide a simple enrollment form and process</li>
</ul>

Back in April 2013, the <a href="http://www.cutimes.com/" target="_blank">Credit Union Times</a> published an article entitled "<a href="http://www.cutimes.com/2013/04/17/digital-title-fraud-fight-makes-case-for-elt?t=lending" target="_blank">Digital Title Fraud Fight Makes Case for ELT</a>" by <a href="http://www.cutimes.com/author/michelle-samaad" rel="author">Michelle A. Samaad</a>. The article begins by discussing a vehicle title fraud incident: "If ever there was a case for moving from paper vehicle titles to an
electronic system, advocates might point to a recent occurrence in
Michigan."<br />

Trying to reduce fraud has been a key part of our <a href="http://etitles.blogspot.com/2013/07/what-is-elt.html">Electronic Lien and Title (ELT)</a> solution, <a href="http://www.etitlelien.com/" target="_blank">Premier eTitleLien™</a> from the initial design in 2005. We've seen evidence of that with our customers, as the article quotes <a href="http://www.dditechnology.com/" target="_blank">DDI</a>'s president, Glenn Thames. <br />

Thames <a href="http://etitles.blogspot.com/2009/11/does-elt-help-prevent-fraud.html">recalled how one credit union</a> in South Carolina was able to uncover fraudulent title activity at a dealership. While the dealer was charged and ended up going to jail, the credit union lost $50,000 and another was bilked out of $200,000.<br />

In the roughly 20 states that allow it, Decision Dynamics provides VIN inquiry access to its customers, Thames said. The company also does lien alerts so that pending lien holder notifications in a credit union’s system are flagged. Financial institutions can tell if scammers are trying to make the rounds to obtain loans.</blockquote>

As an ELT Service Provider, our customers are lenders (banks, credit unions, dealers, and others). We provide services for our customers, including an interface to each state DMV's Electronic Lien and Title program.<br />
<br />
Occasionally we have a vehicle owner contact us directly instead of their lender or the state DMV and we like to assist if possible. One question came recently from an Ohio owner needing their title:

There are a number of features of the <a href="http://www.azelt.com/" target="_blank">Arizona Electronic Lien and Title (ELT)</a> program that help make the program effective for lenders and their customers (vehicle owners):<br />
<ul>
<li><b>All titles with liens are electronic titles.</b> This helps prevent incorrectly receiving paper titles - a problem that can occur in states that offer both ELTs and paper titles with liens.</li>
<li><b>Immediate lien release.</b> Lenders have the option of sending a transaction outside of the daily process to promptly remove their lien and allow the vehicle owner to pick up a clear title (no lien) from an MVD office. Owners do not have to wait the normal 3-5 business days for the title to arrive in the mail.</li>
<li><b>Repossession process does not require a paper title.</b> Often, states require that an ELT be printed for any change to a title, including applying for a repossession title. Arizona does not require that an ELT be printed to accompany an Affidavit of Repossession.</li>

The Arizona Electronic Lien and Title program has been in place since 2003. The Arizona MVD began <a href="http://etitles.blogspot.com/2010/01/arizona-mandatory-elt-by-may-31.html">requiring participation</a> on May 31, 2010, and <a href="http://www.dditechnology.com/" target="_blank">DDI</a> has been providing <a href="http://www.etitlelien.com/" target="_blank">ELT services</a> in Arizona since then.<br />

We recently updated our Washington ELT information site, <a href="http://www.waelt.com/">WAelt.com</a>, with information about the Washington ELT program, the second state to establish such a program. The following are a couple FAQs from that site.<br />
<br />
<strong>Can ELTs be released using a paper lien release document? If so, does the state send notice?</strong><br />
Yes with an <a href="http://www.dol.wa.gov/forms/420040.html" target="_blank">Affidavit of Loss/Release of Interest</a>. WA does not send a lien release notification. From the March 2008 ELT System Guide:<br />
<blockquote>
When a customer pays off their loan and cannot wait for the electronic title release transaction to be processed, the financial institution or their service bureau may issue a “system” produced ALOT ["Affidavit in Lieu of Title"] on their official letterhead which must be signed by a representative of the financial institution but does not need to be notarized. By signing off on an ALOT the financial institution releases all interest in the vehicle, however this will not remove their name from DOL’s database until another transfer transaction takes place. There is no cost to the financial institution for an ALOT.</blockquote>
<strong>How can I get a vehicle title record?</strong><br />
The <a href="https://fortress.wa.gov/dol/ivipsprod/" target="_blank">WA DOL IVIPS program</a> offers a "Vehicle/Vessel Inquiry" service that provides title history information. An account is required. DDI includes this inquiry in Premier eTitleLien™.<br />

The <a href="http://www.flhsmv.gov/" target="_blank">Florida Department of Highway Safety and Motor Vehicles</a> offers a number of different ways to find out information about a vehicle title.
<br />
<ul>
<li>Online through the Florida <a href="https://services.flhsmv.gov/MVCheckWeb/" target="_blank">Vehicle Information Check</a>. This service is free and looks up vehicle title record information by VIN or title number. It does not include owner name or address information.</li>
<li>By mail using the <a href="http://www.flhsmv.gov/data/past.html" target="_blank">Form HSMV 90510 - Driver License, Motor Vehicle/Vessel Records Request</a>. The title record request is approximately $1.00 per page and includes a complete vehicle history with owner names and addresses. This is not a public service - access to title information is protected by <a href="http://www.flhsmv.gov/ddl/DPPAInfo.html" target="_blank">Driver Privacy Protection Act (DPPA)</a></li>
<li>Lenders who participate in the (<a href="http://etitles.blogspot.com/2012/11/florida-approves-mandatory-use-of.html">now mandatory</a>) Florida ELT program automatically receive title information directly from the state. <a href="http://www.etitlelien.com/">Premier eTitleLien™</a> formats that title record information and compares it to existing information on file to note differences as they arrive.</li>
</ul>

Thursday, September 5 marks the last day the <a href="http://www.dmv.ca.gov/" target="_blank">California DMV</a> will accept new applications to enroll in the <a href="http://www.caetitlelien.com/" target="_blank">California Electronic Lien and Title</a> (ELT) program before 2014. Participation in the CA ELT program has been mandatory since January 1, 2012, though the DMV has not enforced that requirement.<br />
<br />
California only enrolls new participants once a quarter. Applications for the next enrollment period are required approximately 4 months prior to the go live date. The DMV reviews all applications and, once approved, sends a copy of the ELT contract to each participant (lender) which must be signed and returned to the state.<br />
